Jack Bauer Gets Taken for a Ride

This time last year, Kiefer Sutherland was being released from jail on the DUI he got after leaving a FOX party with a little too much booze in his system. Seems someone's learned a lesson -- at last night's "24' party, he had a driver.

Donald Sutherland -- Allergic to Kiefer?

Donald Sutherland's publicist smells a rat! A rep for the Golden Globe-winning actor refused to allow him to be interviewed at the "Fool's Gold" junket last Friday -- after she got a whiff of cigarette smoke!
Composite of Donald and Kifer Sutherland
Donald has a "serious, serious" smoke allergy says the rep, and there are always strict guidelines in place to ensure he's not exposed to secondhand smoke. Just prior to Donald's arrival at the junket, some staff members had been puffin' away on the balcony -- and that just wasn't going to work.

Incidentally, Sutherland's son, "24" star Kiefer, is rarely seen without a cig. TMZ caught Donald hugging his smoky son last week, after Kiefer's release from jail. Perhaps he held his breath.

Sutherland's publicist had no comment on how he manages his extreme allergy around Kiefer.

Kiefer Still Doing Time -- And Laundry

Keifer SutherlandTMZ has exclusively learned that Kiefer Sutherland will not be released early -- he's gotta do his full 48 days. He checked in on Dec. 5.

According to officer John Balian of the Glendale PD, Kiefer's not gonna get the Michelle Rodriguez treatment. His release date is scheduled for January 21.

Kiefer is still behaving well, and is considered an A+ type of inmate. He does not complain about anything and is still on laundry duty. He was never assigned to kitchen stuff.

Sutherland has not received visitors throughout his stay in jail -- no one came during the holidays -- or his birthday, but he gets tons of mail from fans all over the world.

Kiefer Is Currently Being Booked

UPDATE: Kiefer was just booked. He is officially an inmate. The booking records show he is 5'10", 150 lbs, blue eyes, blond hair, 40 years old. The arrest time (surrender) was 5:30 PM and he was booked 16 minutes later. According to Glendale PD PIO John Balian he will wear a standard issue orange jumpsuit.

TMZ is at the Glendale City Jail where Kiefer Sutherland is currently being processed. We're told he is wearing slacks and a collared shirt ... for now.

Jail officials tell us he will be searched, have a booking photo taken and be placed in a holding cell awaiting cell assignment. We're told he'll also be served dinner tonight. We hear the chicken ala king is the best!

He was scheduled to turn himself in on December 21, which happens to be his birthday. The plan was to serve when the show was on Christmas hiatus. But because of the writers strike and the fact that the show is on ice, Kiefer checked in earlier.

The Glendale City Jail has 96 beds and 48 cells. The cells are double occupancy -- 10 x 8. There's a toilet, washbasin, water fountain in each cell and a shower in the day room area.

When it comes to visitation, it won't be touchy-feely. All visitations are done on video between 1:00 and 4:00 PM for 15 minutes. A max of two visits per day are permitted.

TMZ spoke with Glendale Police Chief Randy Adams, who said Kiefer will be treated "just like anyone else," adding, "The fact that he's a celebrity -- he checked that at the door when he checked in." Chief Adams said Sutherland will perform laundry and kitchen duties and will serve the entire 48 days consecutively. The Chief said Kiefer will not share a cell, but that is S.O.P. in Glendeezy because all "long term inmates" get their own digs.

Adams also says Kiefer has been "cooperative."

Prosecutor in Kiefer Case -- A Slammer Jammer

TMZ has obtained the sentencing recommendations in the Kiefer Sutherland DUI case.

The sentence is complicated, but Kiefer will do 48 days in custody.

Kiefer will do 18 days for the probation violation, surrendering December 21. He will serve an additional 30 days for the current DUI and must complete that sentence by July 1.

Based on what TMZ knows about production schedules, that would mean Kiefer is serving the bulk of his sentence when "24" is on Christmas holiday and not in production -- he may have agreed to the speedy disposition of the case in order to protect the show from having to shut down production.

Kiefer's lawyer, Blair Berk, would not comment on the case.

UPDATE: A rep for Twentieth Century Fox and the FOX Broadcasting Group issued this statement: "Today our friend Kiefer Sutherland resolved his criminal case at the earliest opportunity. Kiefer made clear to us at the time of his arrest that his first concern was the welfare of those he worked with and that he intended to do whatever was necessary to prevent shutting down the show because of his situation. He told us that even if he had to sacrifice more time in custody in order to protect the show and the jobs of those who work with him, he would do so. From what occurred today, it is evident he is a man of his word. We wish him well and look forward to a long relationship with him."

Kiefer Sutherland Pleads Out

kiefer sutherlandKiefer Sutherland has just copped a plea in his DUI case.

Sutherland did not appear, however -- his high-powered lawyer, Blair Berk, showed up in downtown L.A. and entered a no contest plea to one count of DUI -- driving with a .08 or higher.

This is Kiefer's second DUI conviction. Back in 2004, he pled no contest to driving with a .22 blood alcohol level and was sentenced to five years probation. Today's plea means Kiefer violated probation and could be sentenced to a year-and-a-half in the slammer.

Get this -- the judge who was supposed to hear the case was Michael Sauer, the same judge who nailed Paris Hilton. Sauer was on vacation today and the ever-wise Berk was able to get the case transferred to Judge Stuart Rice.

Judge Rice will sentence Kiefer on December 21. Kiefer's probation is revoked pending the future hearing.

Kiefer has been ordered not to drive between November 9 and the December hearing.

Kiefer to Cop a Plea

ExclusiveUPDATE: Kiefer has pled no contest to. Click here for more info.

TMZ has learned Kiefer Sutherland will plead no contest to DUI, and it's happening in a matter of minutes.

Sutherland was arrested on September 25th in L.A. and charged with two misdemeanor counts of DUI. Cops say Kiefer blew more than a .16, more than twice the legal limit.

Back in 2004, Sutherland plead no contest to DUI where he was driving with a .22 blood alcohol level. He was placed on five years probation. Today's plea deal means Sutherland is essentially admitting to a probation violation -- a violation that could land him in jail for up to a year and a half.

Interestingly, the judge in the 2004 case is Michael Sauer, famous for throwing the book at Paris Hilton. Sauer is on vacation today. Sutherland's mega-lawyer, Blair Berk, will go into another courtroom and a different judge will take the plea.

The judge will set a sentencing date today.
