A jury in the Bahamas investigating the death of Anna Nicole Smith's son Daniel has ruled it was caused by an accidental drug overdose, recommending no criminal charges be filed.
This verdict is huge because of what the jury didn't say -- that Howard K was responsible for the death.
The jury unanimously concluded Daniel died from "non-dependent drug use" -- meaning he wasn't addicted to what killed him.

Big news in the Daniel Smith inquest -- the magistrate in the case will not be giving the jury the option to rule his death a homicide.
In a Bahamian court today, the parties discussed four possible options as the cause of death -- accident, "misadventure," non-dependent drug use and an "open verdict."
We're told the magistrate will instruct the jury on those options on March 31.
No one, including Virgie Arthur's lawyer, suggested that homicide was an option.
As for the options, "misadventure" is defined as "a hazardous course of action which ended fatally." An open verdict means the jury can't decide the specific cause of death.

Howard K. Stern testified today at the inquest into the death of Anna Nicole's son, Daniel.
Stern said he had no idea Daniel was taking any kind of prescription medication, including Methadone. Stern said from September 2005 until June 2006, he wasn't even around as much because he was working full time on Anna's fight with Pierce Marshall.
Stern said there was no duffel bag full of medication at the hospital where Daniel died. He said neither he nor Anna brought any medication into the hospital. As for Stern giving Daniel Methadone, he said absolutely not.
Stern said when he first learned that the toxicology report said that Methadone or any other medication was in Daniel's system, he didn't believe it.
Stern also talked about the photo he took in the hospital room of Anna with Daniel after he died. He said Anna would not believe Daniel had died and she wanted to bring Daniel home with her. Stern testified Anna wanted him to take a photo because she couldn't accept Daniel was dead and needed the photo for proof. Stern said he took the photo, never made money off it and would do it again.

Larry Birkhead has just testified in the Bahamas in the inquest involving the death of Daniel Smith, Anna Nicole's son. Some of the testimony about drugs is pretty shocking.
Birkhead testified that in April 2006, Anna realized some of her Methadone was missing in her Studio City home. Birkhead said Anna had surveillance cameras in the house, checked them and found video proof that Daniel and his buddies were the culprits.
While Birkhead was under oath, he was asked about statements he made to the cops back in 2006, when he was at war with Anna. He had told police he saw Howard K. Stern smoke pot with Anna and Daniel. During his testimony, Birkhead said he was not completely clear on what he saw.
UPDATE: Birkhead also told cops Anna had given Daniel Ecstasy, but on the stand Birkhead said he couldn't say this actually happened.
Birkhead said Daniel's personality completely changed between January 2006 and May. He saw Daniel throw a TV through a window. Daniel often stayed out all night long and Anna was worried.
Also, Daniel was admitted to an L.A. hospital for misuse of valium in mid July, 2006.

The new E! show "Pop Fiction" sounds like a complete rip off of another pitch -- "Celebrities Strike Back." Oh, by the way -- it was pitched by Anna Nicole Smith more than three years ago and there could be a lawsuit.
"Pop Fiction," produced by Ashton Kutcher's Katalyst Television, debuted last night. It seems identical to a treatment obtained by TMZ that Anna Nicole registered with the Writers Guild in 2004. Now get this -- in 2004, Anna Nicole and Howard K. Stern met with Jeff Shore and Jay James, both programming execs for E!. They pitched the show and sent Shore the treatment.
We're also told Anna Nicole and Howard K. met with then E! Prez Ted Harbert in 2004 and also raised the show.
Ashton's show sounds like a carbon of Anna's treatment -- "...what happens if Anna Nicole Smith and other celebrities turn the tables and capitalize off of the overzealous media? What if the next big supposed scandal is not a scandal at all? What if everything is staged, but the media (and the public) don't know it?" It continues, Anna Nicole and other celebrity guests take aim at the media and push all the limits."
That's Ashton Kutcher's show and we're told Howard K. has already threatened suit. What is really pissing him off is that he and Anna had multiple meetings with E!. Two months ago, Stern spoke with E! again on behalf of the estate and the network seemed intrigued by making Larry Birkhead the celeb to do the first prank and then host the show. Ultimately Jay James said it just wouldn't work. Oh really?
UPDATE: A rep for E! tells us, "'Pop Fiction' is a program independently created and developed by Ashton Kutcher's company, Katalyst. 'Pop Fiction' is not based on any idea or concept that may have been pitched to E! by any other party."

Anna Nicole Smith's 18-month-old daughter Dannielynn has been declared the sole heir to the former Playmate's estate.
Smith's attorney and companion Howard K. Stern had sought to clarify Smith's final wishes as her will was written in 2001 -- five years before the little girl was born.
In addition, the judge also established a trust in Dannielynn's name, and named Stern and the child's father Larry Birkhead as co-trustees.
The toddler could stand to inherit millions from the fortune of her mother's late husband, billionaire J. Howard Marshall, which is still tied up in a heated court battle.

A few of the players in the ongoing Anna Nicole Smith saga met up at her grave site today to observe the one-year anniversary of her death.
Alleged former lover and manager Howard K. Stern ('memba him?) and former Bahamian Immigration Minister Shane Gibson, who curiously greenlit Anna's visa, were spotted at a memorial service for the former Playmate.
Larry Birkhead posted a message to Anna today on his website: "I love you and hope you are proud of our beautiful baby girl. Please watch over us and guide us on our journey through life. We miss you."

Larry Birkhead feels like crap.
Birkhead spoke with TMZ a few minutes ago and said he didn't travel to the Bahamas for the Daniel Smith inquest because he was hospitalized with a temp of 106. Birkhead says he's been in the hospital twice with a severe case of the flu and was too sick to travel. Ditto Dannielynn, who has an ear infection.
Birkhead says he's already made arrangements to testify at the inquest sometime in March.
Also, the photo we ran earlier today, showing him out dancing -- was taken on his birthday last week and just released today.
For the record, his voice sounds like Kathleen Turner.

The inquest into the death of Anna Nicole's son resumed today in the Bahamas, with new testimony about how the former Playmate traveled with a cache of drugs in a Coach duffel bag.
Ford Shelley, a South Carolina real estate developer who once rented a house to Anna, testified today that when Anna came to visit, he and his wife found methadone in her luggage.

Dannielynn and Who's Your Daddy of the Year Larry Birkhead arrived at LAX last night -- and it looks like baby scored some serious Christmas presents!
TMZ caught Larry shielding his daughter from the cameras at the airport as he brought her to their waiting SUV, then doubling back to the baggage claim to collect an obscene amount of luggage from the terminal. According to Larry, the bags were Dannielynn's, full of "presents she racked up" from Santa.
Someone's been a good girl this year!
